Welcome to BuyOil.com (the “Site”), operated by Advantage Dist. & Lubricants, LLC (“we,” “us,” or “our”). By accessing or using our Site, or by purchasing products from us, you agree to be bound by these Terms of Use (“Terms”). If you do not agree to these Terms, you must not access or use the Site.
To access certain features, bulk pricing, or industrial credit terms, you may be required to register an account. You agree to provide accurate, current, and complete information. You are solely responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. We reserve the right to suspend or terminate accounts that we suspect of fraudulent or unauthorized activity.
All product descriptions, specifications, and recommendations provided on the Site are for informational purposes only. You, the buyer, are solely responsible for determining the proper product, viscosity, and formulation for your specific machinery, vehicles, or equipment. You must consult your Original Equipment Manufacturer (OEM) manual before purchasing or applying any product. Advantage Dist. & Lubricants, LLC disclaims any liability for equipment damage, failure, or voided warranties resulting from the selection or use of an incorrect product.
Petroleum products, lubricants, and chemicals are hazardous materials. By purchasing from the Site, you acknowledge that you have access to, have read, and understand the Safety Data Sheets (SDS) for the products you order. You assume all responsibility for the safe handling, storage, use, and transportation of these products upon receipt. Furthermore, you agree to comply with all applicable local, state, and federal environmental laws and regulations (including EPA guidelines) regarding the proper use, containment, and disposal of used oil, chemicals, and their empty containers.
All shipments are made “FOB Origin” (Free on Board Origin) from our facility in Rochester, Minnesota, or designated fulfillment centers, unless otherwise explicitly stated in a specific purchasing agreement. This means that the title to the goods, and the entire risk of loss, damage, spills, or delays, transfers to you (the buyer) the moment the carrier picks up the shipment from our dock. You are responsible for filing any freight claims directly with the carrier for damaged or lost goods.
Due to the volatile nature of petroleum markets, prices displayed on the Site are subject to change without notice. We reserve the right to adjust pricing, apply fuel surcharges, or pass along unexpected freight costs prior to final shipment. You are responsible for all applicable sales, use, excise, and environmental taxes associated with your purchase, which will be added to your invoice where required by law.
Due to the risk of chemical contamination and product degradation, we maintain a strict return policy.
All content on the Site, including text, graphics, logos, images, and product descriptions (including but not limited to Duragard product assets), is the exclusive property of Advantage Dist. & Lubricants, LLC or its content suppliers and is protected by United States and international copyright and trademark laws.
The Site and all products sold through the Site are provided on an “as is” and “as available” basis. To the fullest extent permitted by law, Advantage Dist. & Lubricants, LLC disclaims all warranties, express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the products will meet your specific requirements or that the operation of the Site will be uninterrupted or error-free.
In no event shall Advantage Dist. & Lubricants, LLC, its directors, officers, employees, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Site or the products purchased. This includes, without limitation, damages for lost profits, business interruption, facility downtime, equipment replacement, or environmental cleanup costs. Our total aggregate liability to you for any claim arising out of or relating to these Terms or your purchase shall not exceed the actual purchase price paid by you for the specific product giving rise to the claim.
You agree to indemnify, defend, and hold harmless Advantage Dist. & Lubricants, LLC and its affiliates from and against any and all claims, liabilities, damages, losses, fines, penalties, and expenses (including reasonable attorneys’ fees) arising out of or in any way connected with your breach of these Terms, your improper use or storage of the products, or your violation of any environmental laws or third-party rights.
These Terms and any separate agreements whereby we provide you services or products shall be governed by and construed in accordance with the laws of the State of Minnesota, without regard to its conflict of law principles. Any legal action or proceeding arising under these Terms shall be brought exclusively in the state or federal courts located in or serving Olmsted County, Minnesota.
We reserve the right to update, change, or replace any part of these Terms of Use by posting updates and changes to our Site. It is your responsibility to check our Site periodically for changes.
